I think that civil marriage is a bit of a misnomer. There is a very slight sense of an “us” and a “them”. There is also a very slight sense of “I” and “we.” The “us” and the “them” are the same person, the legal documents are the same person, and the “I” and the “we” are the same person.
If civil marriage was defined by these ideas, it might be defined by the phrase “we the people”. But that doesn’t mean that we should all be together. The opposite will probably be true as well. Everyone will have a few “us” and a “them”. That is the “us” which represents the individual rights of each person. Those “them” include a large group of people who are the opposite of us. The opposite of us is the “them”.
Thats right. If civil marriage is defined only by the people and the us, then you can’t be married to your ex. That is because the opposite of us is the them.

So why do some people get married? Why would anyone in a marriage say, “I will marry you because I love you” rather than “I will marry you because I want you to.” This is not to say that there is no place for sex in a marriage. Not at all. But its a given that we will have sex because we want to.
Most marriages last three years. It doesn’t matter to anyone except the two people involved that they last 3 years. But we know it matters. We know that sex and marriage have a very long history of mutual attraction. And if you think that marriage is a zero-sum game in which one party is always in a better position to be married than the other, then you probably don’t know that much about the history of marriage.
